With
the arrival of spring, people's thoughts turn to yard cleanup and
remodeling projects. Canal Fulton has a Zoning Code
which sets certain standards for property maintenance. I will
try to answer the most frequently asked questions.
Do I need to obtain a Zoning Permit to put in a swimming pool, install
a fence or put in a yard barn or deck? The answer to all the
above is YES. The fee schedule for the above items
is as follows:

Due
to an unfortunage incident that occurred in the City last summer
involving a swimming pool, the Canal Fulton Zoning Code covering
Swimming Pools, while not complicated, is very specific on its requirements,
and is reproduced here for your information.
Swimming
pools, public or private inground or above ground swimming, wading
or other pools having the minimum capacity to contain four feet
of water depth shall require a permit, shall not be located in front
yard and shall conform to the following:
Eight foot side and rear
lot lines
Above ground pools, exclusively of any decks going part way around
or all the way around, may not be built within eight feet of the
rear or side lot lines.
Inground pools may not have any below grade exterior wall built
within eight feet of the rear or side lot lines.
The construction, plumbing, and electrical requirements, inspections
and other safety facilities shall be regulated by the County or
State Codes.
All
permanent outdoor swimming pools shall be enclosed with fencing.
Inground pools and the area immediately surrounding the pool shall
be enclosed by a fence having a minimum height of four feet.
Above ground pools shall have a side wall/fence height of a minimum
of four feet. Above ground pools shall be equipped with a
locked gate or ladder, which shall be secured to prevent entry when
the pool is not in use. A removed ladder may be substituted.
The
above code is very specific, in that a minimum of a four foot side
wall must be maintained on above ground pools and the pool cannot
be dug into the yard to make it level and have less that a four
foot side wall all the way around. If you find it necessary
to do this, you must have the area around the pool protected by
a four foot fence.
If
you build a deck around any part of your pool, it must be protected
by a four foot fence/railing and be secured by a locked gate when
not in use.
